Sample Property Rental Agreement

Property Physical Address: 75 Locust Street, Falmouth MA 02540.

It is important you read and understand all of the terms and conditions detailed in this agreement, as it governs the understanding between the Vikinn, Inc. (dba 75 Locust, the "Host") and you (the Guest(s)). Understanding these terms and conditions will help avoid misunderstandings and improve your experience and stay.

THE PARTIES. This Vacation Rental Agreement (“Agreement”) made on {{reservation_date}} between the following:

Guest: {{guest_name}} (“Guest”), and

Host: {{host_name}} (“Host”).

THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

The portion of 75 Locust Street designated as the "Large Estate" (comprising Main Estate House and Guest House) (or Guest House, Main House or Loft Hideaway)

The "Large Estate" is hereinafter known as the “Premises.”

RENTAL AGREEMENT TERM. The Guest shall be allowed to occupy the Premises starting {{checkin_date}} from {{checkin_time}} and ending {{checkout_date}} at {{checkout_time}} (“AGREEMENT Term”).

OCCUPANTS. The total number of individuals staying on the Premises during the Agreement Term shall be a total of {{number_of_guests}} guests. Guests will provide a written list of all occupants in advance of check in date; additional occupants require advance notice and approval. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host.

SUBLETTING. The guest does not have the right to sublet the Premises.

PAYMENTS. For all reservations made 61 days or more in advance, 75 Locust requires payment and deposit of an amount equal to 50% of the rental amount. This will result in an “accepted” reservation. This accepted rental reservation is not final and confirmed until an executed copy of this contract is received together with the 50% rental deposit and a security deposit is received by the host.

For all reservations made less than 61 days in advance, we require 100% payment of the combined total rental charges, taxes, fees, as well as an executed rental agreement, and applicable security deposit to confirm the reservation. Reservations will not be considered confirmed until the sum of these costs are paid in full.

 SECURITY DEPOSIT. The Guest shall be obligated to pay the following amounts upon the execution of this Agreement:

The Security Deposit is for the faithful performance of the Guest under the terms and conditions of this Agreement. The Guest must pay the Security Deposit at the execution of this Agreement. 75 Locust requires a security deposit in the amount of $500 for the Guest House, $500 for the Loft Hideaway, and $1000 for the Estate House. All rentals 30 days or longer require a security deposit of $1500.00.

This deposit is held as security in the event of damages to the property from the guest. This includes damages to fixtures and equipment, as well as any missing property.

*Please report any damages to property and fixtures, or any maintenance issues, as soon as they come to your attention. We want to ensure the property is in the best possible condition during your stay, and make certain the property is in the best possible condition for guests arriving after your departure.

Security deposits will be processed, and returned as appropriate, within 14 days of your vacate date, less any itemized deductions. The deposit amount does not represent a limit to the guest’s liability, nor does it release the guest from responsibility and liability for damage due to the following: Intentional, willful, reckless, or malicious acts of the guest or others at the property during the tenancy.

Damage by animals, birds, or pets brought to the property by the guest.

Damage caused by smoking.

Theft from the property of either the owner’s property or property belonging to the guest or others, where the property was not locked and secured.

Negligence of guests or others on the property during the tenancy, or intentional misuse of furnishings, appliances, equipment, or other amenities provided with the home.

Damage caused while under the influence of alcohol or drugs.

Damage to the property, or personal property, resulting from the operation of any motor vehicle by a guest or others on the property during the guest stay.

Breach or violation of any terms and conditions of this agreement, resulting in damage to property.

CHECK IN AND CHECK OUT. To maximize our guests' time on the property, our turnover time window in between guests is tight. Our team is scheduled well in advance with limited availability. Guests will be charged, and agree to pay, $275.00 if they have not vacated the house(s) at the agreed check out time (10:00 am on the day of departure), and for each hour past, due to cleaning and laundry constraints. Check out time is 10:00 am on the scheduled day of departure, and check in time anytime after 4:00 pm on the scheduled day of arrival.

PROPER VACATE CONDITION. The property is expected to be returned in a clean condition. Should the property be returned in a very dirty or rough condition, additional cleaning charges will apply at a rate of $95.00 per hour. 

KEY CHARGES. Unreturned key charges are $25 per set.

PETS. No more than one dog is permitted ( some breed restrictions apply ) and must be agreed to by the Host at the time of Guest Booking. A Flat Rate Pet Fee will be charged. No pets of any other type, other than dogs, are permitted. The Host only allows dogs that are stated by Guest, and agreed upon by Host and Guest, at the time of booking: There are no additional pets of any kind allowed on the Premises under any circumstances. If the Guest is found to have additional pets on the Premises, beyond those agreed to at time of booking, this Agreement and any Security Deposit shall be forfeited.

If agreed in advance that your dog may be on the property, please either bring dog blankets to cover sofas and furniture that you allow your dog on, or alternatively please keep them off all furniture. We are happy to provide dog blankets, sheets to cover the sofas, and dog-designated towels with advance notice.

SMOKING POLICY. The 75 Locust property is an entirely non-smoking property. Under no circumstance are guests, or guests of guests, allowed to smoke, or vape, inside or outside on the property grounds at any time. 

LINEN AND CLEANING. The Linen and Cleaning Charges are detailed at the time of booking. Linen and cleaning fees for off season and longer term rentals vary, and will be specified as appropriate. 

UTILITIES. The Host shall be responsible for all utilities and services to the Premises EXCEPT for the following: None.

 ACCESS. Our maintenance team requires occasional access to the basement of the Estate House. (Irrigation system controls, mechanical, etc.) This access is facilitated through the rear mudroom, and an exterior door off the kitchen. (The interior door between this mudroom and kitchen maintains the privacy of House guests. Please keep this interior door closed at all times).

INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings.

QUIET ENJOYMENT. Quiet hours begin at 10:00 PM each night and continue until 8:00 AM. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents. The guest shall not disturb, endanger, or annoy neighbors. Nor shall the guest utilize the property for any immoral purpose, or violate any law or ordinance. Please be aware, several neighboring businesses do intermittently generate noise during normal business hours.

TRASH SERVICE. Guests leaving on a Sunday do not need to worry about curbside trash disposal.

Guests staying over a Sunday night: place trash and recycling bins curbside, either Sunday evening or early Monday mornings (by 7:00am). Town of Falmouth empties bins on Monday mornings. Recycling is the same day and time, but only every other week. (the red "Falmouth Recycling Calendar")Please separate trash and recycling, place in the appropriate bins prior to your departure. Trash and recycling bins are by (or behind) the white fence to the left of the garage. In July and August, additional trash and recycling bins by company ‘Cavossa’ will be picked up weekly, usually on Tuesdays and Thursdays.

PARKING. Guests of the Main Estate House are limited to a total of 4 vehicles. Guests of the Guest House are limited to 1 vehicle. Guests of the Loft Hideaway are limited to 1 vehicle. Additional parking space(s) are possible in some circumstances, but require prior arrangement and approval with us. Please inquire.  

OUTDOOR SECURITY CAMERAS. 75 Locust has installed outside security cameras on the property: two overlooking the parking lot, one on each side of the main house. These are used for security purposes in the off-season. On check-in and check-out days, they also allow us to know when our housekeepers and contractors arrive and leave.

WEATHER. 75 Locust is not responsible for, nor can control weather events. In the event of storms, hurricanes, or other weather events, the guest agrees to hold 75 Locust harmless for damages or harm to the guest or personal property. Unfortunately, we cannot make exceptions to our cancellation policy due to weather events.

CANCELLATION POLICY. All reservations canceled in writing at least 60 days before scheduled arrival and check in are fully refundable.   

Reservations canceled in writing, between 59 and 31 days prior to check in are refundable in the amount of 50% of your rental amount, plus all taxes and fees. In the event that you have to cancel within this timeframe, 75 Locust will remarket the property immediately, making a best effort to replace your reservation. If your reservation is successfully rebooked, we will refund your reservation proportional to 80% of the total gross reservation amount of the replacement booking. For example, if payment for your reservation was made in full, 80% of the replacement total rental payment would be refunded to you. If only the initial 50% partial payment was made, you would receive a refund of 80% of this payment. (if necessary, we may have to reduce the rental rates to improve booking probability. The new rates will be set at our sole discretion).

Reservations canceled 30 days or fewer before scheduled arrival are non refundable. However, in the event you need to cancel within 30 days, we will remarket the availability immediately. If we are able to successfully rebook the reservation within 30 days prior to arrival, we will refund you an amount proportional to 50% of the total replacement booking rental amount. If we are unable to rebook the reservation, all your prior rental payments are forfeited.

 TRIP PROTECTION. We understand things happen, and highly recommend trip protection to protect against last minute emergencies. On a site called Insure My Trip (https://www.insuremytrip.com/), guests can get quotes from many insurance providers. Our understanding is they have coverage for delays or cancellations due to transportation issues, weather, peril, job loss, and medical crisis. The policies have added benefits for medical care while away, including medical evacuation. We do not have personal experience with the Insure My Trip website so we cannot personally recommend it.

COVID 19 WAIVER. Guest agrees and understands safety precautions and efforts of property owner to clean and sanitize the property are not “foolproof”, and agrees to hold property owner harmless to any health problems, casualties, contagions, viruses (specifically the Covid 19 virus) which the guest(s) may acquire during or after use and occupancy of the property.

HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.

The properties at 75 Locust were originally built in the 1800s. Living in a house constructed prior to modern building codes involves certain inherent risks and dangers. These include, however are not limited to, tripping, falling, breaking bones, or receiving head injuries. These events could lead to significant personal injury, or even death.

The guest(s) hereby acknowledges these risks as a condition of renting the property, and agrees to hold Vikinn, Inc. (75 Locust), as well as it’s officers, employees, representatives, and agents harmless from any third party claims for injuries, damages, or losses of any nature whatsoever which may occur as a result of use of the property.

ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.

ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of prepaid Rent.

POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.
